My daughter is currently suing for divorce and retained a law firm in November 2008.  She has no means of support and husband has control of all of the considerable assets and monies.  Husband has stated that my daughter will never receive a dime of support and to date has refused to provide any such support.  I am funding her support and lawyer fees but have limited ability to do so for any length of time.  Her lawyer petitioned for an emergency support hearing and earliest he could get  was 4/10/09 (over 4 months delay).  Then, at the 4/10/09 hearing her lawyer kept trying to get her to settle marital asset splits (without any prior warning) and never once mentioned spousal support!  As it was not possible to settle asset splits in such an ad hoc manner, the hearing adjorned without any support order at all!  I can only surmise that he was not prepared to ask for spousal support in the first place!  The delay obviously works to her husbands advantage as he can just try to !

wait out my ability to fund my daughter's expenses.  Her attorney appears to be useless so we retained another attorney and terminated that attorney's services. 

Another issue I would like to point out is that when I asked her attorney what his strategy was to achieve a fair divorce settlement and obtain some spousal support he appeared to have no clue as to why a strategy was needed!

Additionally, on advice from another attorney with family law experience, we asked for an emergency 15 min. hearing.  This was objected to by husbands attorney and her attorney could not seem to offer any compelling argument for support!

Additionally, my daughter had a protective order to keep husband away from her place of residence and husband's attorney filed a motion to dismiss the order.  Again her attorney was absolutely impotent in defending her need for such an order dispite eveidence of spousal abuse!

 

All of the above suggests to me that her attorney does not have her best interests in mind or he is incredibly naive or inexperienced or both.  I am tempted to accuse him of collusion with the opposition but of course I could never prove this.
