Greetings:

You asked Davis to respond to the charge that she was in possession of stolen US Government property and as such she was subject to discipline under Oregon State Bar Rules.

Davis on May 30, 2008 wrote you back and in 4 pages, basically said that John F. Folliard, Jr. is stupid. She never addressed your question but instead, like an octopus using ink to cover up her deeds, spoke a little of this and a little of that. Ironically, she provides you with a demand from the highest judge of the United States Social Security Administration, telling Linn in polite terms that she has in her possession stolen property and that the United States demands it back immediately. (This was the first polite contact from Social Security. The next would have been a lawsuit by the United States Justice Department with the Oregon State Bar as the defendant).

But still in a defiance and an arrogance that can be seen again and again by the Oregon State Bar as they betray Oregon citizens in their duty to protect against malfeasance by Oregon lawyers, she still waits three weeks before finally surrendering the stolen property back to the United States government and MONTHS AND MONTHS after she is first informed that she is in possession of stolen property. She thinks you are stupid to not notice this, Mr. Folliard.

I have earlier provided you with the Oregon Revised Statutes regarding possession of stolen property and have pointed out to you that Davis and the OSB has met every element, knowingly. I have pointed out to you that putting a band-aid over the stolen Social Security number on the stolen disk is not a defense under the criminal law of Oregon. The highest judge of the United States Social Security Administration has also pointed out to Davis that this does not make the crime any less a crime as he demanded the return of the stolen US Government property.

 

Davis states to me in writing that the CD and copy of a decision arrived and that she had no communication with this anonymous person who submitted it. Interesting that she does not give you a copy of that. Now, she says on May 30, 2008 that “Dan R. Hyatt submitted (the stolen US Government Property) in connection with his concern…” I have demanded a copy of all communications that she has had with Dan R. Hyatt and she lied to me and said there were none and that somehow this stolen US Government property, containing confidential information, somehow just arrived on her desk in the big Oregon State Bar building and she instinctively knew, because she had no other tasks, that she should listen to that particular portion of the CD and draw that particular conclusion. In short, she lied when she said that she got no letter from Dan R. Hyatt and the CD just arrived and by magic she knew just what to do. As she lied there, she can also be seen to be lying now and she thinks that you are stupid, Mr. Folliaird and that you will fall for her lies.

I don’t think that about you. But I have little faith that this will result in anything other than another cover-up and whitewash as a special investigator just happens to find that a member of the Oregon State Bar has done nothing wrong even though the conclusion can only be that she possessed stolen US Government property, knew it for months and months and refused to send it back until nicely threatened by the highest judge of the United States Social Security Administration.

Any ethical person in our profession would have seen that it was stolen and/or arrived by suspicious methods and contacted Social Security for guidance. Furthermore, Davis should have then issued a subpoena to the Social Security Administration for a copy of the tape without the Social Security number. This way, Mr. Moody’s rights would have been protected and due process of law would have been honored. Instead, Davis acted lawlessly and caused all these events to occur.

She makes much of a conversation that someone at OSB had with another complaining person regarding this stolen property-Moody. I again tell you that I am acting with his specific handwritten instructions and don’t know who the OSB really spoke with. I telephoned the number they provide and Mr. Moody does not even live there.

More importantly, thinking you are stupid, Davis is acting like the octopus spreading ink to hide her culpability. What she says, even if true (it is not) is irrelevant to any element of whether she is culpabe for possession of stolen US Government property. Why? Because you now have THREE complainants regarding possession of this stolen property by Linn Davis and the OSB. Those complainant are;

I will hope you do your duty here but I am reminded of what Steven Duin of the Oregonian stated one Sunday:

"...just how low the Oregon State Bar will go... the hypocrites who sit in judgment over the legal community can barely recognize, much less weed out, the untoward conduct in their own camp."

Dan R.Hyatt
is a member of the Oregon Bar. 
He must be a member of the bar to be eligible to be an administrative law judge. 
He currently is employed by the Social Security Administration as an administrative law judge out of the Portland Oregon ODAR.
