(I seek to file a complaint regarding Oregon Bar Member attorney Bruce Brewer). He reviewed mine and my spouses information given to him by myself and my spouse and agreed to represent us. That was in 2003. It's now March of 2007, and no information or correspondence, i.e. telephonically unless he responded to multiple requests to do so, which I believe in 3 years, I have had him contact me maybe 5 times! His office says he's waiting for this hearing or that hearing. They would send me medical release forms telling me he had none, yet though I had mailed one back 2 months prior.
(When Bruce Brewer was asked, he'd reply,) "oh I had forgotten." Let alone the numerous before that. Then it became clear Bruce Brewer was not keeping abreast of events in my cases. He figured my claim would be easy, should have been done 3 years ago. All the evidence and judicial and ethical misconduct that had transpired at the previous haring. Brewer Brewer has already informed me that I had already filed the appeal. Bruce Brewer assured me he would telephone them and notify them as to his representation of us. He told me he would rewrite his own appeal on my behalf. He never did and my case was denied on appeal to the Appeals Council of Social Security. I have made repeated requests for court documents concerning our cases. (Bruce Brewer's) office tells us he doesn't normally send clients court papers because there is so much of it and it would take too much ink and I would have to pay "x" amount for each page.
No problem. Well, you can fax it to me then. the point was
Bruce Brewer's office staff and himself
seemed to find every reason for not sending me
copies
of paperwork. Bruce Brewer finally wrote a letter to my spouse
informing her that the Appeals Council denied her claim and he doesn't think the
appeals Court (9th Circuit) would overturn it. She hired another lawyer
(other than Bruce Brewer) and they were able to get her benefits in 4 weeks that
Bruce Brewer couldn't do in years.
I sent forms from Bruce Brewer to file in Federal court. Bruce Brewer claimed that nothing was happening on the federal case. Since I couldn't get Bruce Brewer to give or send any document or information concerning the federal case, much less get him on the phone, I went to the clerk of courts and looked up the case myself and found that Bruce Brewer had repeatedly filed motion after motion for an extension (7 times). we had found that Bruce Brewer had asked for the case to be remanded (back to Social Security rather than get an order that I be paid benefits) because he couldn't file his brief in a timely manner. He asked for 7 extensions of time.
Bruce
Brewers legal brief was so full of errors regarding my medical history and
the case itself, Bruce Brewer neglect and outright failed to represent me before
the court. Bruce Brewer had and does have medical records that show that I
have uncontrolled epilepsy, yet he failed to argue this point in his brief and
he also neglect to defend my credibility, as I was told to my face
(by lying judge Administrative Law Judge Dan R.
Hyatt ~two federal magistrate
judge have labeled Administrative Law Judge Dan R. Hyatt a serial liar) that I was lying about my
epilepsy and accused of trying to commit fraud.
Bruce Brewer
made no attempt to argue or defend my credibility for a Paramedic/Field Training
Officer, my credibility is the utmost importance for I would not have
been entrusted in that position, had my credibility been called into question.
Bruce Brewer made no attempt to keep me informed about anything regarding this case.
Bruce Brewer's staff stated that they would check on whether serial lying judge Administrative Law Judge Dan R. Hyatt had recused himself and then turned around and told me that ALJ recused himself. HE LIED!
Bruce Brewer hadn't submitted anything to the court, so my wife began gathering additional medical records and statements that the ALJ requested. Someone scheduled 2 different medical appointments in 2006 without my doctor's knowledge or apparently Bruce Brewers. Bruce Brewer said that SSA requested it. I telephoned the MDs and was told that I had no physicians and that's why I needed to see them. Once I brought SSA up to speed, the woman was upset because neither my attorney Bruce Brewer or anyone else told them that I had been under the care of neurologist for 6 years. She canceled the appointments, and then Bruce Brewer claimed that I never showed up, and I informed Bruce Brewer that they were cancelled because he didn't notify anyone that I had already had a physician and that I had been under his care of 7 years. Bruce Brewer's actions have jeopardized my relationship with my neurologist, who had no knowledge of the appointments arranged on my behalf until the medical records showed up on his desk, for tests and exams he hadn't ordered.
Bruce Brewer has not gathered the necessary and pertinent information needed to develop the case and his inaction has stalled the case again.
Bruce Brewer lied concerning the fact he told me he filed in federal court (9th Circuit) and found he did not. Bruce Brewer lied and told me that my medical records were frozen, yet they weren't, he just didn't bother getting any. My wife got them. Bruce Brewer lied. They weren't "frozen".
Bruce Brewer did nothing to defend my credibility and allowed serial liar judge Administrative Law Judge Dan R. Hyatt to accuse me of committing fraud and faking seizures. Bruce Brewer did nothing when serial liar judge Administrative Law Judge Dan R. Hyatt called my wife a flat out lair and that she would lie for the benefit of her family. Bruce Brewer failed to argue the time line correctly in his own brief relating to my seizure activity, including how long I was on short term disability and when I finally had to leave my career.
The case was sent again back to Social Security hearings and appeals due to Bruce Brewer's neglect. Bruce Brewer was forced by his own inaction and neglect to enter into an agreement with SSA to have the case reversed and remanded back down to the office of hearings and appeals. It is clear that the credibility problem lies with Bruce Brewer, serial liar Judge Administrative Law Judge Dan R. Hyatt , Administrative Law Judge Dan R. Hyatt and not the Social Security Administration itself.
