so we waited 2 more hours for another judge to hear the case.

We go to the other judge and it is Merrill Schneider's turn to talk.  Merrill says,

"the guy called me every day.  Judge the guy is an ass hole."

The judge said, "MR SCHNEIDER, YOU'RE AN ATTORNEY AND I DON'T EXPECT TO HEAR SUCH LANGUAGE COMING FROM AN ATTORNEY!' 

Schneider, "sorry judge, sorry."

Then the defendant is laying out his case (?) and Schneider is bent over, nearly with his head between his knees.  the judge says, "MR SCHNEIDER, SIT UP STRAIGHT!!" 

Schneider, "sorry judge, sorry."

Dear Scott:

2 minutes in reading your Oregon Rules of Professional Conduct reveals that an Oregon lawyer cannot call an opposition litigant “an asshole” in court. If you don’t have the Rules of Professional Conduct for your state I would be glad to mail you one.

The judge found it so offensive that he admonished Merrill Schneider in Court and had to remind him, “I never expect to hear such language from you Mr. Schneider, you’re a lawyer.” (or words to that effect)

Here’s your code: DR 7-106 Trial Conduct.

(C) In appearing in his professional capacity before a tribunal, a lawyer shall not: (6) Engage in undignified or discourteous conduct which is degrading to a tribunal.

I suppose you could let Merrill Schneider off for calling Kent Coffman “an asshole” if such conduct was NOT undignified or discourteous but the judge quickly said that it is -or- that he was not appearing in “professional capacity before a tribunal…”

I must agree, that Merrill Schneider calling a former client “an asshole” might not be deemed very “professional” (as the judge scolded) and that Merrill Schneider will not be disciplined by the Oregon Bar, just as it did not discipline him for lying about his drug taking, LSD dropping, etc. to an Appeals Judge and the Oregon State Bar. If he can get away with taking dope and lying about it to you, I suppose you’ll probably not bother with Merrill Schneider calling an Oregon citizen “an asshole” in an Oregon Court and being admonished by the judge for his crudeness.
