The State Professional Responsibility Board has directed me to advise you of its opinion that your conduct in this matter did not comply with the disciplinary rules.

Specifically, Ms. D signed a contingency fee agreement with your office on October 19, 2001 authorizing you to bring action on her personal injury claim against TriMet. Ms. D has been represented by attorney Neil Jackson on this matter and in November 2001, Mr. Jackson told you that her case had been dismissed with her consent. Thereafter, your staff worked to obtain Ms. D’s records from Mr. Jackson until March 12, 2002, when Mr. Jackson delivered the complete file to you.

At that time, you confirmed that Ms. D’s case had been dismissed and determined that there was little hope of recovering funds from TriMet. However, you did not convey this information to your client until February 10, 2004, almost two years after you obtained the file and more than two years after Mr. Jackson first advised you that her case had been dismissed. By failing to timely communicate your assessment of your client’s claim, you neglected the legal matter she entrusted to you, in violation of DR 6-101 (B).

It has been determined that no formal disciplinary proceedings will be instituted against you, but that the matter will be concluded with this letter of admonition. You are urged to take this matter into account when faced with similar circumstances in the future.

I was never informed by Merrill Schneider’s law office that Merrill Schneider perceived my case as hopeless. In fact, I have never met or spoken with Merrill Schneider although I have made a couple of phone calls to his office to speak with him with no success.

In Merrill Schneider’s letter to you dated 3/30/2004, he states that he is relatively sure that my daughter understood my case was hopeless.

My daughter states that she was never informed by Merrill Schneider or anybody else in his legal practice that my case was hopeless, or that he didn’t want to represent me as a client.

His letter dated 02/10/2004 releasing me as a client came as a total shock. Until that time, I was under the impression that my case was actively being worked.
