Complaint against attorney Merri

In the week following this accident, we both went to Merrill Schneider’s office to get advice regarding our rights as victims of this accident. We were ushered into an office and spoke with “senior paralegal” Christi Carner and a small-framed woman who said that she was an attorney with the firm. We believe that we both signed representation agreements with the Schneider law Offices, but were not given copies of this agreement.

Christi Carner called up our medical doctor’s office and rudely demanded copies of all our medical records. When Christie was told by the receptionist of the office that she would have to send a written request with authorizations signed by us and prepay for the records, she was even ruder. We demanded that Christi apologize to our medical doctor’s office for her rudeness and Christi wrote a letter.

Christi said that they were going to send a demand letter to the insurance company for the pickup driver, demanding $125,000.000 each. However, the only offer that Schneider Law Offices received from the other insurer was for $7,800.00 (plus PIP repayment and other payments) on each case.

Once, a man came into the office by himself and introduced himself as our attorney. This man sat down and asked us, “where did you get hurt?” We responded by asking him who he was and if he was our lawyer, why didn’t he know where we were injured? After all the paperwork we had brought in to his office the last ten months, he should have at least known where we were injured, but he did not seem to know anything whatsoever about our case.

This attorney then asked us why we went to our medical doctor for treatment, and once again we were told that our MD charges too much money. HJ was even asked if she was related to this medical doctor. This made HJ very angry as this doctor had been her doctor for years, since the birth of her last two children. This doctor speaks Korean, which is HJ’s language of origin and she is very comfortable with this doctor.

Then while speaking to both of us, but looking at HJ, this attorney Merrill Schnedier called her a “con artist” and told us that we would have to find another attorney to represent us in this matter. We asked this attorney for our papers, but he said “no.” Two days later, we received a letter from him telling us not to call his office again.

On Friday, October 24, 2003, we went to our medical doctor’s office and told them what had happened and that Merrill Schneider had resigned from representing us. We called Merrill Schneider’s office and left a phone message that we wished our files sent to our new attorney. We received a letter from Merrill Schneider, dated October 27, 2003, in which he falsely states that we indicated that we would be seeking out a new counsel. This is a total falsehood as Merrill Schneider told us that we needed to find another attorney. Merrill Schneider resigned, we did not dismiss him. I have enclosed a copy of this letter, which also indicates that Merrill Schneider has filed liens in our cases and that he is withholding our files for payment of his liens. Merrill Schneider did not pay for or obtain our medical records, police report, etc. We did obtained them on our own and we feel he has no right to withhold these items as he resigned from representing us both in this matter.

It is obvious that Merrill Schneider never even looked at any of our records, called HJ a “con artist”, resigned as our attorney and then filed a lien for the work he never did and is to date withholding our records that we personally obtained and turned over him.
