My Social Security Number being transmitted outside of your office
Dear Director:
Often times I take over a case as attorney for a social security claimant when their file is already at the Office of Disability Adjudications and Review. On that SSA 1695 form, (so that SSA can make my payment directly into my bank account for attorney fees) I must give my Social Security number.
I have now been contacted by a component of the Social Security
Administration that a SSA 1695 that I filed at ODAR has gone missing.
From the evidence before me it appears that an ALJ in your office has sent a
private Social Security number of a claimant across state lines in violation of
all privacy laws and of your own regulations.
Dan Hyatt has stated that he will take retaliatory actions against me in the future (“I’ll give you attorney fees of $100 a case…I’ll continue your hearings five times if I want to.” etc.) As such, I fear that Dan Hyatt might misuse the SSA 1695 with my social security number affixed to it. I have constant assurances from SSA when I file the SSA 1695 that my social security number will be safeguarded but again, Dan Hyatt has already told me that he will retaliate against me and already my SSA 1695 has turned up “missing” after being filed in your office-an officer where Dan Hyatt works and has access to your nearly 10,000 cases waiting for hearing.
I have now identified TWO breaches of security at your office where a Social Security number of a claimant was sent across state lines anonymously by someone in your office to parties that were not cleared or briefed on the use of such an crucial item.
Now that we have identified at least two security breaches at your office, what assurances can you give me that Dan Hyatt or others will not have access to my social security number and SSA 1695 for possible misuse?
